TERM AND CONDITIONS

PLEASE READ THESE SALES TERMS AND CONDITIONS CAREFULLY, AS THEY CONTAIN IMPORTANT INFORMATION RELATING TO YOUR RIGHTS AND OBLIGATIONS, AS WELL AS POTENTIAL LIMITATIONS OF LIABILITY AND DISCLAIMERS THAT MAY APPLY TO YOU.

These  Terms and Conditions apply to your purchases made through the Mizuno Hong Kong Online Store. By placing an order, you confirm that you have fully read, understood, and agreed to be bound by these terms and conditions.

1. Definition

(i) "Customer" refers to the person who places the order;
(ii) "Product" means any item listed on the website;
(iii) "Seller" means Mizuno Hong Kong Online;
(iv) "Website" refers to the website located at mizuno-hk.com.

2. Placing an Order

2.1 The information on this website is an invitation to offer and shall not be construed as an offer to supply any products.
2.2 When a customer places an order via the website, the customer agrees to purchase the product under these terms and conditions. The seller reserves the absolute discretion to accept or reject any order.
2.3 Upon receiving an order, the seller will verify product availability and the customer's credit and payment details. Until the seller sends an order confirmation email and dispatches the product, the seller is not obliged to supply the product.

3. Product Supply

3.1 The seller may agree to supply products ordered on this website under these terms and conditions.
3.2 Upon dispatch of ordered products, the seller will send the customer a confirmation email.
3.3 Product images and descriptions on the website may not exactly match the actual products. The seller reserves the right to supply products that do not exactly match the pictures, as long as the product's performance is consistent with the description.
3.4 The seller may substitute or modify products ordered without materially affecting the overall function or type of the product.
3.5 If ordered products are out of stock, defective, or otherwise unavailable, the seller may cancel the order and offer a replacement product or refund.

4. Price and Payment

4.1 Product prices are as stated on the website at the time the customer places the order.
4.2 All prices are in Hong Kong Dollars (HKD). Any other currencies shown on the website are for reference only. Payment must be made in HKD.
4.3 Customers must provide valid credit card details or other checkout information to successfully pay for their orders. Other payment methods such as cash on delivery or bank transfer may incur additional charges at confirmation or before shipment.
4.4 Mizuno Hong Kong Online will take reasonable precautions to secure customer payment and order information. The seller disclaims any liability for losses resulting from unauthorized access to customer data.

5. Delivery

5.1 Products will be delivered to the address provided by the customer. The seller has absolute discretion to select the courier and delivery method.
5.2 Risk of loss or damage to products passes to the customer upon delivery and acceptance at the provided address.
5.3 Delivery dates are estimates only and not part of the contract. The seller will endeavor to deliver on time but is not liable for any delays caused by unforeseen circumstances.
5.4 The seller is not responsible for taxes, customs restrictions, clearance fees, or regulations outside Hong Kong. Customers are responsible for complying with the laws and paying any charges in their country.
5.5 If delivery is unsuccessful, products may be held at the local post office or courier warehouse. Customers must arrange pickup; the seller will not handle or follow up on collection.
5.6 If products are returned to the seller due to failed delivery, shipping costs will be charged to the customer. Returned products may be resold, and the seller is not obliged to retain or resend them.

6. Returns and Refunds

6.1 Buyers may request a return within 7 days of receipt, except for the following exclusions:
(a) Return requests made after 7 days of receipt;
(b) Returns without prior request and acceptance by the seller;
(c) Clearance sale items, tights, socks, or towels;
(d) Products not purchased from Mizuno Hong Kong Online;
(e) Failure to return the goods to the seller;
(f) Goods that do not comply with the return policy.
6.2 Upon receiving returned products, the seller will inspect and verify if they meet return conditions before arranging refunds.
6.3 If returned products do not meet the return conditions, the seller will resend the original products to the customer at the customer’s expense.

7. Amendments

The seller may update or revise these Sales Terms and Conditions, product prices, and website information at any time. Customers are responsible for reviewing these terms and prices. Continued use of the website indicates acceptance of any changes.

8. Force Majeure

The seller is not liable for delays or product failures caused by force majeure events such as natural disasters, fire, floods, accidents, riots, war, government policies, strikes, or other uncontrollable circumstances. Product availability depends on supply; the seller has full discretion over sales and delivery arrangements during shortages.

9. Intellectual Property

9.1 Customers acknowledge that all copyrights, trademarks, and intellectual property rights in materials provided remain the property of the seller or licensors and may only be used with express authorization.
9.2 Materials and content on the website are for personal, non-commercial use only. Customers must not download, copy, distribute, republish, transmit, resell, or create derivative works from any website materials or images.
9.3 Prices listed do not include technical data, copyrights, trademarks, or other intellectual property rights contained in the products or packaging.

10. Liability

 10.1 Products are provided "as is" and "subject to availability." Except with explicit seller consent, the seller makes no representations or warranties about the information, content, services, or products, whether express or implied, including suitability or accuracy. Customers use the website at their own risk.
10.2 To the maximum extent permitted, the seller disclaims implied warranties such as merchantability, non-infringement, or fitness for a particular purpose.
10.3 The seller is not liable for any loss of income, profit, contract, data, or indirect or consequential damages arising from the use of this website, regardless of legal theory.
10.4 Seller’s maximum aggregate liability shall not exceed the total amount the customer paid for the relevant products.

11. Waiver/Invalidity

Failure to enforce any term does not constitute waiver of rights. If any provision is invalid or unenforceable in any jurisdiction, it will not affect the enforceability of that provision elsewhere.

12. Headings

Section headings are for reference only and do not form part of these terms or the contract.

13. Entire Agreement

These terms constitute the entire agreement between the customer and seller regarding use of the website and purchase of products, superseding any prior agreements.

14. Governing Law

14.1 These terms shall be interpreted under Hong Kong law. Any dispute shall be subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region, i.e., the location where the customer submits, accepts, or receives the order.
14.2 These terms are provided in both Chinese and English. In case of any discrepancy, the English version shall prevail.
