MIZUNO HK Terms and Conditions of Service and Sales

Please read these Terms and Conditions of Service and Sales (hereinafter referred to as the "Terms") carefully, as they contain important information regarding your rights and obligations, as well as limitations of liability and disclaimers that may apply to you.

Since our exclusive distributor, Ichikawa Sangyo Co., Ltd. (ISCL), introduced MIZUNO to Hong Kong in 1975, we have been continuously committed to providing a premium experience for our local customers. We, namely the exclusive distributor Ichikawa Sangyo Co., Ltd. (ISCL) (hereinafter collectively referred to as "we", "us", or "MIZUNO") and our affiliates, may provide various features and services (hereinafter collectively referred to as "Services") through our website (including the MIZUNO HONG KONG ONLINE store), sports equipment, wearable devices, and other products. By creating an account, using our Services, or placing an order to purchase goods on the online store, you acknowledge that you are fully aware of the contents of these Terms and agree to be bound by them.


Part 1: Service and Account Terms
1. Acceptance of Terms of Service and Age Restrictions

By creating an account or using our Services, you confirm your acceptance of these Terms. You also confirm that:

  • You are 18 years of age or older; or
  • You are 13 years of age or older but under 18 years of age (a "Minor"), and declare that you have reviewed these Terms with your parent or legal guardian, and that your parent or guardian understands and agrees to these Terms.

If you are a parent or guardian and allow a Minor to use these Services, you agree to: (i) supervise the Minor's use of these Services; (ii) assume all risks associated with the Minor's use of these Services; (iii) assume any legal liability resulting from the Minor's use of these Services; (iv) ensure the accuracy and truthfulness of all information submitted by you or the Minor; and (v) assume responsibility and be bound by these Terms regarding the Minor's access to and use of these Services. Depending on the applicable laws and regulations in your jurisdiction, our children's usage policy may prevent you from creating an account or using our Services.

2. Using Our Services
  • License: We grant you a limited, non-exclusive, non-transferable, and revocable limited license to use our Services. You may only use the Services for personal and non-commercial purposes in accordance with these Terms and the instructions we provide within the Services. You acknowledge and agree that our Services are owned by us and our partners, and are protected by applicable copyright, trademark, patent, and other intellectual property laws. These Terms do not grant you any ownership interest, but only a limited, revocable right of use.
  • User Guidelines: To protect the safety of all users and ensure uninterrupted Service, you agree to comply with the following rules:
    • Do not reverse engineer, decompile, or attempt to discover the source code or algorithms of us or the Services.
    • Do not modify or disable any features of our Services, or create any derivative works based on the Services.
    • Do not use our Services for renting, leasing, lending, or providing any commercial hosting services.
    • Do not infringe upon our intellectual property rights or the rights of any other party.
    • Do not use the Services in any manner that violates applicable laws or is fraudulent or malicious (such as introducing viruses or harmful data).
    • Do not use the Services in a way that damages, overburdens, or interferes with other users.
    • Do not illegally collect data from the system or attempt to decipher server transmissions.
  • Internet and Third-Party Services: Our Services may require internet access, and you acknowledge that this may incur network charges. In addition, our Services may contain information, links, or content provided by third parties ("Third-Party Services"). We assume no responsibility for, nor do we have control over, Third-Party Services.
3. MIZUNO HK Account and Inactivity Policy

You may need to create a "MIZUNO Account" to use certain Services (such as member benefits and online shopping). By creating an account, you agree to provide accurate information, properly safeguard your password, and update your information when it changes. If you suspect your account has been compromised, you should contact us immediately.

  • Inactive Account Policy: If a MIZUNO account has no activity (including logging in, using Services, or purchasing on the official website) for more than twenty-four (24) months, we will classify it as a long-term inactive account. MIZUNO reserves the right to delete such accounts and their associated data.

Part 2: Mizuno Hong Kong Online Sales Terms
4. Definitions and Order Formation
  • "Customer" / "Buyer": Refers to the person placing the order.
  • "Product" / "Goods": Refers to any product listed on the Mizuno Hong Kong Online website.
  • "Seller": Refers to Mizuno Hong Kong Online.
  • Order Confirmation: The information contained on this website should only be considered as an invitation to treat. After a customer submits an order, the Seller has the absolute discretion to decide whether to accept it. Until the Seller confirms inventory and payment details, emails a dispatch confirmation, and ships the product, the Seller is under no obligation to provide the product.
5. Product Supply
  • When the ordered product has been shipped according to the customer's order, the Seller will confirm by email.
  • The images and descriptions of the goods on the website may not completely match the actual item. As long as the performance is equivalent, the Seller reserves the right to supply goods that do not completely match, or to make reasonable substitutions or modifications that do not affect overall functionality.
  • If the product cannot be provided due to out-of-stock, defects, or other reasons, the Seller reserves the right to cancel the order and provide a replacement product or a refund.
6. Pricing and Payment
  • The price of the product is subject to the price listed on the website at the time the order is submitted.
  • All prices of goods are calculated in Hong Kong Dollars (HKD), and HKD is the only accepted payment currency (other currencies are for reference only).
  • Customers must provide a valid credit card or designated checkout information to pay for the order. Other payment methods (such as cash on delivery, bank transfer) may incur additional fees.
  • The Seller will take all reasonable precautions to keep payment information secure, but if the information is intercepted without authorization, the Seller shall not be liable for any resulting losses.
8. Delivery
  • Products will be delivered to the address provided by the customer. The Seller has absolute discretion in choosing the delivery company and method.
  • The risk of loss and damage to the product shall pass to the customer upon delivery of the product to the designated address and receipt by the recipient.
  • Delivery dates are estimates only and do not form part of a contract. The Seller shall not be liable for delays caused by unforeseeable circumstances.
  • The Seller is not responsible for taxes, customs restrictions, or customs clearance matters outside the Hong Kong area.
  • If an order cannot be delivered and is stored in a logistics warehouse, the customer must arrange for self-pickup; if it is returned to the Seller, the resulting shipping costs shall be borne by the customer, and the Seller is under no obligation to reserve or reship the product.
9. Returns and Refunds

The buyer may submit a return request to the Seller within 7 days of signing for the goods. The following situations will not be accepted:

  • Exceeding 7 days after signing for the goods.
  • Returning the goods independently without submitting a request or without the Seller's acceptance.
  • Clearance sale items, designated special products, leggings, socks, or towels.
  • Goods not purchased at Mizuno Hong Kong Online.
  • The buyer fails to return the goods.
  • The condition of the goods does not meet the requirements of the return policy.

After the Seller receives and inspects the goods to confirm they meet the requirements, a refund will be arranged. If the condition does not meet the requirements, the product will be returned to the customer, and the resulting shipping costs will be borne by the customer.


Part 3: General and Legal Terms
10. Modifications and Termination
  • Changes to Terms: We may update or amend these Terms and website information at any time. For material changes, we will post them on the website or notify you by email. If you continue to use the Services or this website after the updated Terms take effect, it indicates your agreement to abide by and be bound by the amended Terms.
  • Termination of Service: You may terminate these Terms at any time by deleting your account and ceasing to use the Services. If we reasonably suspect that you have violated these Terms, applicable laws, or if we decide to terminate part or all of the Services, we may suspend or delete your account and access to the Services at any time. Termination of these Terms does not prejudice any rights and liabilities accrued by either party during the term of validity.
11. Force Majeure

The Seller shall not be liable for any delays, product failures, or shortages caused by force majeure factors (including but not limited to natural disasters, fires, floods, accidents, riots, wars, government policies, strikes, or any circumstances beyond the Seller's control).

12. Intellectual Property and Copyright Policy

We respect the intellectual property rights of others. These Terms do not grant you the right to use the MIZUNO name or any MIZUNO trademarks, logos, and distinctive brand features. The copyright, trademark rights, and other intellectual property rights of all materials provided to customers and website content remain the property of the Seller or relevant licensors at all times. Customers may only use the website content for personal, non-commercial purposes, and are strictly prohibited from downloading, reproducing, copying, publishing, distributing, reselling, or creating derivative works in any form. The intellectual property rights attached to the product or packaging are not included in the price of the product. If an account is found to have committed multiple infringements, we may suspend or delete the account.

13. Limitation of Liability

The goods and services provided on this website are provided on an "as is" basis. Unless expressly agreed by us, we make no express or implied warranties (including warranties of merchantability or non-infringement) regarding the quality, suitability, accuracy, or completeness of the services or goods. The use of this website and services is at the customer's own risk.

To the fullest extent permitted by applicable law:

  • We are not liable for any loss of revenue, loss of business, loss of data, or any indirect, incidental, special, or consequential losses.
  • Our maximum aggregate liability to you, whether based in contract, tort (including negligence), or otherwise, shall in no event exceed the total amount paid by you for the goods or services in question.
  • These Terms do not exclude or limit our liability for death or personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
14. Indemnification

If, with our express consent, you use our Services in your business, trade, or profession, you agree to indemnify and hold harmless us and our affiliates, officers, and employees from any third-party claims, losses, damages, and legal expenses (including reasonable attorneys' fees) arising out of (i) your use of the Services not in accordance with these Terms; (ii) a breach of this agreement; or (iii) a violation of laws or infringement of third-party rights.

15. General Terms
  • Governing Law and Dispute Resolution: The interpretation and application of these Terms shall be governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, and the application of the United Nations Convention on Contracts for the International Sale of Goods is excluded. Any disputes shall be subject to the exclusive jurisdiction of the courts of the Hong Kong Special Administrative Region.
  • Entire Agreement and Severability: These Terms, the Privacy Policy, and any other accompanying policies constitute the entire agreement between you and us, superseding any prior agreements. If any provision of these Terms is deemed invalid or unenforceable, that provision will be limited or eliminated, and the remaining provisions will remain in full force and effect.
  • No Waiver: Our failure to strictly enforce any legal right under these Terms shall not be deemed a waiver of that right, and such rights shall remain valid.
  • Survival: Provisions of a continuing nature in these Terms concerning ownership, intellectual property rights, warranty disclaimers, limitations of liability, indemnification, and governing law shall survive and remain binding after the deletion of your account or the termination of these Terms.
  • Electronic Communications: You agree to receive all agreements and notices in electronic form (including emails, push notifications, or text messages).
  • Language Version: If these Terms are available in both Chinese and English versions, the English version of these Terms shall prevail in case of any ambiguity or dispute.
